Current and Effective Electronic Service Policy As Noticed

1. Limited Consent to Electronic Service. SEIGE LAW (the "FIRM") consents to E-SERVICE[1], ONLY to the extent authorized under Cal. Rules of Crt., rule (“CRC”) 2.251(a)[2]  and required by CCP § 1010.6(b)(2)[3] (“MANDATORY E-SERVICE”). ONLY where excluded by CCP § 1010.6(a)(2)[4] from MANDATORY E-SERVICE, above-captioned physical address may be used for service of process.


2. Notice and Change of Address for Electronic Service. The FIRM notices applicable ESA, see ¶ 4. As defined, the applicable ESA is to the exclusion of any and all other email addresses.


3. Response to and Request for Mandatory E-Service. The FIRM hereby gives CCP § 1010.6(b)(4)[5] response to and affirmative request for MANDATORY E-SERVICE on the FIRM subject to CCP § 1010.6(a)(2) Exclusion.


4. Notice of Change of Address for Service of Documents. The FIRM hereby notices CRC 2.200[6], 2.251(g)[7] Change of Address for Service of Documents by mail, express mail, overnight delivery or facsimile transmission replacing any present physical address, facsimile and ESA with the applicable ESA below ONLY. Therefore, all service of documents on the Firm in these proceedings, not excluded from MANDATORY E-SERVICE, must and shall be by E-SERVICE. For the purposes of this Notice, the sole or lead case number, which indicates a Titled Code, shall be considered definitive identification of Titled Code designating applicable ESA from the following list:


a. TO THE EXCLUSION of all other ESA and ONLY for E-SERVICE in proceedings under the Fam. Code and Welf. & Inst. Code:

[1]  E-Service is “. . . service of a document, on a person, by either electronic transmission or electronic notification. [It] may be performed directly by a person, including a party, by a person’s agent, including the person’s attorney, or through an electronic filing service provider [(“EFSP”)], and by a court”. (CCP § 1010.6(a)(1)(A).)


[2]  “When a document may be served by mail, express mail, overnight delivery, or fax transmission, the document may be served electronically under Code of Civil Procedure section 1010.6 . . .” (CRC 2.251(a).)


[3] “A person represented by counsel, who has appeared in [a] proceeding, shall accept [E-Service subject to the Scope of Mandatory E-Service]”. (CCP § 1010.6(b)(2).)


[4]  “If a document is required to be served by certified or registered mail, [E-Service] is not authorized”. (CCP § 1010.6(a)(2).)


[5]  “A person represented by counsel shall, upon the request of any person who has appeared in [a] proceeding and who provides an [ESA], electronically serve the requesting person [subject to the Scope of Mandatory E-Service]”. (CCP § 1010.6(b)(4).)


[6]  “An attorney or self-represented party whose mailing address, telephone number, fax number, or e-mail address [provided pursuant to CRC 2.111(1)] changes while an action is pending must [file and serve] notice of the change”. (CRC 2.200.)


[7]  “A party or other person whose [ESA] changes while [a] proceeding is pending must promptly [file and serve] notice of change of address electronically . . .” (CRC 2.251(g)(1).); “[Use of a EFSP] does not relieve . . . duties under [CRC 2.251(g)(1)]”. (CRC 2.251(g)(2).); “An [ESA] is presumed valid . . . if the party . . . [has not filed and served compliant notice otherwise]”. (CRC 2.251(g)(3).)
